The chairman of the Municipality Council of Pomorie, Stoyan Stoyanov, declared illegal the beginning of construction of the future golf complex in "Hizhata" countryside near Kableshkovo, which started earlier this week.
Stoyanov claims that the start of such construction contradicted to the public interest of people from Pomorie, because the will of the Municipality Council and also of the laws in Bulgaria were not paid regard to. According to the law it's not allowed to begin construction without any project documentation.
The assigning of the terrains in the project happened in violation of the law requirements, says Stoyanov. The lot of about 2000 sq.km. is still stated as agricultural land and in order to begin construction on it, its status has to be changed by a decision of the Ministry of Agriculture.
A certain fee also has to be paid to change this status and it, according to the words of the chairman of the vanishing Municipality Council, represents an enormous sum of millions of leva.This has not been done and the budget never received this amount, added Stoyanov.
Besides that, the City Council of Pomorie never approved a General Building Plan (GBP) of the Municipality which included such golf resort near Kableshkovo, he claimed.
A year ago, however, was approved a Detailed Building Plan (DBP) which included that project, regardless that it has to correspond to the General Building Plan (GBP) and to be approved no sooner than an Evaluation Report about the effect of such project over the environment is made. Such wasn't made back then and this can be seen in the letter of the deputy-minister of environment and water Chavdar Georgiev, dated June 2006, which indicates that this procedure is still in progress.
In his letter Georgiev points that the approval of DBP before the acceptance of the eco-evaluation of the project is a violation of Bulgarian law and the municipality has been notified. The deputy-minister of Regional and Urban Development, Savin Kovachev, also alarmed about a lack of correspondence between the DBP, environmental legislations and the GBP.
Before the start of the construction, however, the company managed to convince the Ministry of Environment and Water to take the lands of the future golf complex out of the "Natura-2000" eco-network
As another malpractice of the investors Stoyanov points the lack of correspondence between the project and the National Electric Corporation and the corresponding electric distribution company; the Water and Sewerage Company, the Basin Department for Management of Water, National Roads Agency, the Regional Inspectorates for Public Health and Environment, etc. The executor of the project also has no contract about building supervision, claims Stoyanov.
In addition he says he doesn't mind the investments and construction of vacation or golf resorts, as long as they are genuine. He points as proof the possibility of constructing another golf complex near the Pomorian village of Lucka, near Kableshkovo, which was announced and sold at an auction.
